Recently, the National Copyright Administration of China announced the third batch of typical cases for building China into a leader in copyright. Shantou’s characteristic-field copyright "head office to head office" mediation-litigation coordination mechanism was successfully selected. The mechanism is jointly advanced by the Shantou Municipal Copyright Administration and the Shantou Intermediate People’s Court. It closely aligns with the "head office to head office" mediation-litigation coordination deployment by the Supreme People’s Court and the Publicity Department of the CPC Central Committee. Based on the actual high incidence of copyright disputes in local toy and garment industries, it provides a replicable copyright protection pathway for the high-quality development of regional characteristic industries.

Addressing industry pain points such as the plagiarism of toy appearances, infringement of apparel patterns, unclear ownership, and non-standardized authorization, the Shantou Municipal Copyright Administration and the Shantou Intermediate People’s Court signed a cooperation memorandum on mediation-litigation coordination. This clarified the division of rights and responsibilities, case circulation, mediation norms, and full-process standards for judicial confirmation, establishing a normalized consultation and information-sharing mechanism. With courts in the jurisdiction as the hubs and linking up with provincial grassroots copyright workstations, a three-level working structure of “municipal-level coordination, inter-departmental collaboration, and grassroots implementation” has been formed. Furthermore, specialized handling standards have been refined around high-frequency infringement types to promote the standardized operation of mediation. The effectiveness of this mechanism and the fact that local leading enterprise Alpha Group Co., Ltd. won the China Copyright Gold Award mutually verify each other—demonstrating that Shantou's toy and garment industries are accelerating their transition from imitation and processing to originality-driven leadership and brand-oriented development.

汕头版权“总对总”诉调机制入选国家典型案例

　　近日，国家版权局公布第三批版权强国建设典型案例，汕头市特色领域版权“总对总”诉调机制成功入选。该机制由市版权局联合市中级人民法院共同推进，紧扣最高法、中宣部“总对总”诉调对接部署，立足本地玩具、服装产业版权纠纷高发实际，为区域特色产业高质量发展提供了可复制的版权保护路径。

　　针对玩具外观抄袭、服装花型侵权、权属不清、授权不规范等行业痛点，市版权局与市中级人民法院签订诉调对接合作备忘录，明确权责分工、案件流转、调解规范及司法确认全流程标准，建立常态化会商与信息共享机制。以辖区法院为枢纽，联动省版权基层工作站，形成“市级统筹、部门协同、基层落地”的三级工作格局，并围绕高频侵权类型细化专项办理标准，推动调解标准化运行。该机制成效与本土龙头企业奥飞娱乐斩获中国版权金奖形成双向印证——汕头玩具、服装产业正加速从模仿加工向原创引领、品牌化方向迈进。
